1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Shiny Windows LLC website at shinywindows.net (the "Site"), and the booking, scheduling, and delivery of any window cleaning, solar panel cleaning, or related services (the "Services") provided by Shiny Windows LLC ("Shiny Windows," "we," "us," or "our").
By accessing the Site, requesting a quote, paying a deposit, or booking a Service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.
You must be at least 18 years old and legally able to enter contracts. By booking a Service, you warrant that you are the property owner or have the property owner's authorization to allow Shiny Windows to perform the Services on the property.
These Terms supplement (but do not replace) any signed Customer Service Agreement provided when you formally accept an estimate. In the event of a conflict, the signed Customer Service Agreement controls.
2. Description of Services
Shiny Windows LLC provides the following Services in Miami-Dade County, Broward County, and surrounding areas of South Florida:
- Residential window cleaning (interior and exterior)
- Commercial window cleaning (offices, storefronts, restaurants)
- High-rise and multi-story exterior glass cleaning
- Solar panel cleaning
- Screen cleaning and reinstallation (when authorized in writing)
- Hard water stain treatment (offered as a separate service; full removal is not guaranteed)
We do not provide the following as primary services: house pressure washing, roof cleaning, gutter cleaning, paint removal, or oxidation removal. If you require these services, we are happy to refer you to a trusted partner.
3. Quotes & Booking
- Free quotes are provided based on the information you supply (window count, building type, location, special instructions). Quotes may also be developed using photos, Google Maps, or similar tools.
- All quotes are estimates valid for 30 days from the date issued. After 30 days, prices are subject to revision.
- The final price may be adjusted on the date of service if on-site conditions differ materially from what was described (e.g., additional windows, harder access, severe water staining).
- A booking is confirmed only when you accept the quote and pay the required deposit (see Section 4).
4. Deposits & Payment
Deposits at booking:
- Residential: A non-refundable deposit of $50 is required at the time of booking, paid through the link provided with the quote.
- Commercial: A non-refundable deposit of 50% of the quoted total is required before any work is performed.
Final payment is due immediately upon completion of the Service, unless we have agreed in writing to alternative terms (such as net-30 invoicing for established commercial accounts).
Accepted payment methods: credit card and debit card (processed securely through Stripe via our service-management software Jobber), Zelle, cash, and check.
Late fees: Any invoice or scheduled payment that is more than 10 days past due will be subject to a 7% late fee. If an invoice remains unpaid more than 30 days past the due date, we reserve the right to refer the account to collections, file a civil action to recover the outstanding amount, and refuse future service.
5. Cancellation & Rescheduling
- 24-hour notice: You may cancel or reschedule a confirmed appointment with at least 24 hours' advance notice at no additional charge. Your $50 residential deposit (or 50% commercial deposit) remains non-refundable but may be applied to a rescheduled service within 60 days.
- Less than 24 hours' notice: Cancellations made within 24 hours of the scheduled service will result in forfeiture of the deposit.
- No-show or denial of access: If our team arrives at the property at the scheduled time and is unable to perform the Service due to denied access, ongoing construction, an unsafe environment, or any other client-caused condition, the deposit is forfeited and an additional $75 trip fee may be assessed.
6. Weather & Force Majeure
Florida weather is unpredictable. For your safety and the quality of the cleaning result:
- We may need to reschedule due to rain, thunderstorms, lightning, hurricanes, tropical storms, or other unsafe weather conditions. There is no charge to you for weather-related rescheduling.
- We will notify you as early as possible and propose the next available date.
- We are not liable for any delay or non-performance caused by events outside our reasonable control, including but not limited to: severe weather, natural disasters, government orders, utility outages, road closures, or supply-chain disruptions.
7. 48-Hour Service Guarantee
We stand behind our work with a 48-hour streak-free guarantee:
- If, within 48 hours of service completion, you find a streak, missed area, or other quality issue with our work, contact us by phone at (305) 452-4791, by text, or by email at shinywindows18@gmail.com.
- We will return promptly and re-clean the affected area at no additional charge.
- The guarantee is void if, after our cleaning, the windows have been exposed to: rain, sprinkler overspray, salt mist, ongoing construction at the property, painting work, lawn-care debris, or any other contamination.
- The guarantee covers cleaning quality only. It does not cover pre-existing window damage, scratches, hard-water etching, or any condition disclosed (or that should have been disclosed) before service.
8. Customer Responsibilities
To allow us to perform the Service safely and effectively, you agree to:
- Provide safe, unobstructed access to all areas to be cleaned.
- Provide a working outdoor water spigot with adequate water pressure (approximately 40 PSI). If you have well water, low pressure, or any unusual water conditions, you must notify us in advance so we can prepare. Bringing supplemental water on the truck may incur additional fees.
- Keep pets and children indoors during service.
- Move vehicles, outdoor furniture, plants in containers, and any sensitive items away from the work area before our arrival.
- Turn off outdoor electrical outlets at the breaker before our arrival.
- Notify us in writing before service of: any cracked or seal-failed windows, brittle or damaged screens, surfaces sensitive to standard cleaning solutions, or any other special conditions.
- Ensure all interior and exterior doors and windows are shut tightly before exterior cleaning begins.
9. Service Limitations & Exclusions
For safety and liability reasons, we will NOT clean or touch:
- Cracked, broken, or seal-failed windows. If we identify a damaged window during pre-inspection or service, we will skip that pane and notify you. This is a safety policy and is not negotiable.
- Windows with failed multi-pane seals (we cannot fix internal fogging; this is a manufacturing defect of the window itself).
- Storm windows showing damage or leakage.
- Windows beyond the safe reach of our standard 28-foot ladder system unless specialized lift equipment is quoted separately.
- Open windows.
Additional services we do not perform or guarantee:
- Removal of paint splatters, tree sap, industrial fallout, artillery fungus, or vine remnants.
- Furniture removal and reinstallation.
- Wasp nest or bird nest removal at unreachable locations.
- Window screen removal: we do not remove screens unless you sign a screen-removal authorization in advance, in which case we are not liable for damage to brittle or worn screens.
- Cleaning of exterior surfaces other than glass and frames.
- Hard water stain removal carries no 100% removal guarantee; severe etching may be permanent.
10. Property Damage & Liability
We carry general liability insurance and take every reasonable precaution to protect your property.
- In the rare event our team causes damage through our negligence, we will work with you and our insurance carrier to resolve the issue. Where possible, we will attempt to repair the issue ourselves first.
- Damages must be reported within 48 hours of service completion. Damages reported after 48 hours are considered waived.
- You agree to allow us 30 calendar days from the date of notification to inspect and resolve any alleged damage before initiating any external action.
We are NOT liable for the following:
- Pre-existing damage noted (or that should have been disclosed) before service.
- Damage caused by improper maintenance, neglect, or low-grade building materials.
- Water intrusion through bad seals, cracks, unsealed windows, or compromised exterior surfaces.
- Damage to brittle, worn, or aged window screens.
- Damage caused by ongoing construction, lawn-care work, or third-party contractors at the property.
- Plant or landscape damage from incidental water exposure during normal cleaning.
- Faulty electrical outlet covers allowing water to seep in.
- Loss of efficacy or warranty of multi-pane windows that already had failed seals.
11. Photo & Marketing Use
By booking a Service, you grant Shiny Windows LLC a non-exclusive, royalty-free, perpetual license to use photographs and videos taken at your property (focused on the windows, glass surfaces, our equipment, and exterior of the building) for marketing purposes including our website, Google Business Profile, Facebook, Instagram, and other promotional materials.
- We do not identify property owners by name or street address in our marketing.
- If you do not want photos or videos taken at your property, you must notify us in writing (text or email) before your appointment. We will honor your request without question.
- You agree not to bring any civil action against Shiny Windows for marketing use that complies with this section.
12. Website Use
Use of the Site is for personal, non-commercial purposes only. You agree not to:
- Copy, scrape, distribute, modify, reverse-engineer, or republish any content from the Site without our prior written permission.
- Attempt to gain unauthorized access to the Site, its systems, or its underlying infrastructure.
- Use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site.
- Misrepresent your identity or affiliation when contacting us through the Site.
All content on the Site (including text, images, photographs, videos, the Shiny Windows logo, and the underlying code) is the intellectual property of Shiny Windows LLC and is protected by U.S. copyright and trademark law.
13. Disclaimers & Limitation of Liability
The Services are provided "as is" within the scope of the agreed quote. Except as expressly stated in writing, we disclaim all warranties (express or implied) including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by Florida law, Shiny Windows LLC's total liability arising from or related to the Services or your use of the Site shall not exceed the amount actually paid by you for the specific Service giving rise to the claim.
In no event shall Shiny Windows LLC, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Shiny Windows LLC, its officers, employees, contractors, and affiliates from any claim, demand, loss, or damages arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) any incorrect or incomplete information you provided.
14. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.
You agree that any legal action, suit, or proceeding arising from or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.
Attorneys' Fees
If either party initiates legal action to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs from the non-prevailing party.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Entire Agreement
These Terms, together with our Privacy Policy and any signed Customer Service Agreement, constitute the entire agreement between you and Shiny Windows LLC and supersede all prior agreements relating to the subject matter herein.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. When we update them, we will revise the "Last Updated" date at the top of this page. Continued use of the Site or Services after an update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
